Como todos los aspectos de la vida en este momento extraordinario, los procesos de inmigración a Canadá han sido afectados por la pandemia COVID-19 (la enfermedad que resulta del coronavirus nuevo).

Nuestros servicios

El despacho Patricia Wells Abogados de Inmigración  sigue brindando servicios a nuestra clientela durante estos tiempos difíciles.  Gracias a las reformas tecnológicas y sistémicas ya establecidas, nuestro bufete está en la vanguardia tecnológica para poder trabajar a la distancia sin interrupción, y al mismo tiempo salvaguardar la salud de nuestros clientes y nuestros empleados.  Seguimos cumpliendo con las fechas límites de los trámites de nuestros clientes, seguimos preparando y entregando las solicitudes, y seguimos ofreciendo consejo legal como siempre. La mejor manera de comunicarse con nosotros en estos momentos – como siempre – es por correo electrónico.  Pero también siguen funcionando normalmente nuestras líneas telefónicas. Lo único que les pedimos es que no vengan personalmente a la oficina sin hablar primero, para arreglarlo con uno de nosotros.  Si necesitan enviar documentos u otros paquetes, también podremos orientarles para hacerlo cuando llaman.

Programas de inmigración

Al nivel del gobierno canadiense y de las provincias, muchos servicios de inmigración siguen. Algunos programas están cerrados de forma temporaria, mientras otros siguen abiertos  pero con modificaciones temporarias.

Los viajes a Canadá, por ciudadanos canadienses, residentes permanentes y otros, han sido restringidos. Las condiciones y las reglas están cambiandose constantamente, para poder responder a las condiciones de la pandemia y las necesidades económicas de Canada.

Está anticipado que al terminar la pandemia, Canadá va a seguir aceptando los inmigrantes, los refugiados y los trabajadores, estudiantes y visitantes temporarios.

Mientras tanto, si buscan información actualizada sobre los efectos de la pandemia en las varios procesos de inmigración y de ciudadanía, y en los servicios de pasaportes canadienses, pueden consultar el sitio web del gobierno de Canada (en inglés o francés solamente): https://www.canada.ca/en/immigration-refugees-citizenship/services/coronavirus-covid19.html

Nota: También habrán interrupciones en los programas provinciales de inmigración (“Provincial Nominee Programs”) por la pandemia.  Para saber detalles, hay que consultar el sitio web de cada provincia.

Finalmente, por todo Canadá muchos de los tribunales – incluso la Corte Federal y los tribunales de inmigración y de refugio – están en el proceso de cambiar sus procesos por la pandemia. Consúlte por favor con su propio abogado o con el tribunal que corresponde, si necesita información específica sobre su caso particular.

Asistencia económica 

El gobierno de Canadá y los gobiernos de las diferentes provincias han hecho disponible la asistencia económica para ayudar a los indivíduos y los negocios afectados por la pandemia. Hay una variedad de programas, incluso para ayudar a los niños afectados, y para facilitar la cubertura médica en estos momentos. Hay varios criterios para los varios programas,  y hasta algunas personas viviendo en Canadá sin ser ciudadanos o residentes permanentes pueden ser elegibles recibir alguna asistencia. Like every other aspect of life around the world, Canadian immigration has been affected by the COVID-19 pandemic (the disease caused by the novel coronavirus).

Our services

Patricia Wells Immigration Lawyers is continuing to assist our clients in these extraordinary times. Our firm has been in the forefront of technology and office processes that allow us to work remotely with no interruptions, so we are able to keep both our staff and our clients safe.  We are continuing to meet deadlines, prepare and file applications, and provide legal advice. as usual.  The best way to contact us now – as at any other time – is by email. However, our phone lines are also open. The only change we need to mention: please do not come to our office at this time unless you call first to make arrangements.  If you need to send us your documents or other packages, we can arrange for that too, when you call.

Immigration programs

At the level of the Canadian government and individual provincial governments, immigration services continue to be offered. Some programs are temporarily closed and many others are open but with temporary modifications.

Travel to Canada, whether by Canadian citizens, permanent residents or others, has been restricted, and the rules and guidelines about who is allowed to come to Canada are changing constantly, in response to the changing pandemic conditions.

It is anticipated that when the pandemic is over, Canada will still be accepting immigrants, refugees and temporary foreign workers, students and visitors.

Meanwhile, you may find up-to-date information about how the pandemic is affecting immigration applications, refugees, citizenship applications, and passport services, at the government of Canada’s website: https://www.canada.ca/en/immigration-refugees-citizenship/services/coronavirus-covid19.html 

Please note that there may also be service disruptions in each provincial government’s immigration programs (“Provincial Nominee Programs”). Consult each province’s website for specific information.

Finally, across Canada many courts and tribunals – including immigration and refugee tribunals – are changing the way they operate because of the pandemic.  Contact your lawyer or the tribunal in question for information about your case.

Financial help

The government of Canada and all provinces have made  financial assistance available, to help individuals and businesses through the pandemic.   Even some people living in Canada who are not yet Canadian citizens or permanent residents may be eligible for these financial benefits.   Please consult the official Canadian government website for detailed information about “Canada’s COVID-19 Economic Response Plan” and specific assistance programs: https://www.canada.ca/en/department-finance/economic-response-plan.html

CAN MY CHILDREN IMMIGRATE TO CANADA?

According to Canadian immigration law, all children under 22 years old and unmarried are considered “dependents” of their parents.  This means all children under 22 years of age and single have the right to immigrate to Canada with their parents (including parents immigrating to Canada in skilled worker and other independent immigration programs, or as refugees or sponsored family members) and they may also be sponsored by their Canadian citizen or permanent resident parents.

Please note: The only exception to the age cut-off is for over-age children who are still dependent because of a medical condition – those children, of whatever age, are still eligible to accompany their parents and to be sponsored.

Important note: If you submitted an application for permanent residence (or if you already sponsored your parents), before October 24, 2017 (the date when the law changed), please contact your lawyer or the Immigration Call Centre (1-888-242-2100 in Canada) – there are special procedures available to add in a child over 18 who was excluded before because of the old rule.

MIS HIJOS PUEDEN INMIGRAR A CANADA?

Segúun la ley de inmigración canadiense,  los hijos menores de 22 años de edad son considerados como “hijos dependientes” mientras siguen solteros/as. Esto significa que son elegibles  inmigrar a Canadá con sus padres – sean sus padres inmigrantes independientes, refugiados o familiares patrocinados – y también pueden ser patrocinados por sus padres ciudadanos o residentes permanentes canadienses.

La única excepción a esta edad máxima es si su hijo/a sigue dependiente por una condición médica. Estos hijos dependientes siempre pueden inmigrar a Canadá con sus padres y pueden ser patrocinados, sin importar la edad.

Nota: Si Ud. ya entregó su solicitud de residencia (o si ya patrocinó sus padres) antes del 24 de octubre  de 2017 (fecha del cambio de la ley), y sus hijos ya eran mayores de 18 años, hay trámites especiales que uno puede hacer para poder incluir hijos que ahora son elegibles. Por favór hable con su abogado o llame al Call Centre de Inmigración (1-888-242-2100).
